These Terms of Service ("Terms") apply to your use of our website and to all training programs, classes, events, and services provided by Body and Mind K9 LLC, doing business as BAMK9 ("BAMK9," "we," "us," or "our"). By using our website, submitting an application, booking a service, or paying for a program, you agree to these Terms.
Our services
BAMK9 provides dog training services in and around Long Beach, California, including private and group training programs, Board & Train, Adventure Academy, community classes, pack walks, and other events, along with online training support. Program details, pricing, and schedules are described on our website and may change over time.
You must be at least 18 years old to book services or agree to these Terms.
Applications and enrollment
Most programs begin with an application and a call with a trainer. Submitting an application doesn't guarantee enrollment. BAMK9 may decline or recommend a different program for any dog based on fit, safety, behavior, or availability. Your enrollment is confirmed once you've agreed to these Terms and made the required payment or deposit.
Payments
- Program payments: payment is due as described for each program, before services begin unless otherwise agreed in writing.
- Pay over time with Affirm: eligible programs can be financed through Affirm. Financing is provided by Affirm, subject to their approval and terms. BAMK9 is not a party to your agreement with Affirm, and your obligations to Affirm continue regardless of your participation in the program.
- Board & Train deposit: a deposit of half the program price is required to lock in your start date. The remaining balance is due in full before your program begins.
- Adventure Academy: Adventure Academy is billed monthly by automatic payment. Your plan continues month to month until you cancel with at least 30 days' notice.
- Extra sessions: additional sessions beyond what's included in your program are available at an additional cost.
No refunds
All payments and deposits are non-refundable, including Board & Train deposits, program fees, and monthly Adventure Academy payments.
The one exception is our Groundwork upgrade credit: if you upgrade from Groundwork to Foundations within your first 3 Groundwork sessions, including the owners-only session, your Groundwork payment is applied toward the price of Foundations.
Scheduling and missed sessions
- Rescheduling: private sessions may be rescheduled with at least 24 hours' notice. Sessions canceled with less notice, or missed without notice, are forfeited.
- Group classes: Groundwork does not offer makeup classes. Makeups for Foundations group sessions are at your trainer's discretion.
- Adventure Academy: missed or skipped outings do not roll over to the next month.
- Cancellations by BAMK9: if we cancel a session due to weather, safety, illness, or other circumstances, we'll work with you to reschedule it.
- Arrival: please arrive on time. Late arrivals don't extend your session or class time.
Your dog's health and safety
You agree that your dog is in good health and is current on all required vaccinations, and that you'll provide proof if asked. You agree to tell us about any bite history, aggression, medical conditions, or behavior concerns before training begins and if anything changes.
BAMK9 may pause, change, or end services with any dog if we believe continuing would put people, dogs, or our trainers at risk. If BAMK9 ends services for safety reasons, any credit or refund is at BAMK9's sole discretion.
If your dog is injured or becomes ill while in our care and we can't reach you, you authorize BAMK9 to seek veterinary care for your dog, and you agree to pay all related costs.
Training methods and tools
BAMK9 uses both motivation and clear communication, including food, toys, and training tools such as slip leads, prong collars, and e-collars when appropriate for the dog and program. Your trainer will explain any tool before it's used, and you agree to follow your trainer's instructions for using tools safely at home.
Results
Dogs are living beings, and results depend on many factors, including your dog's history, health, and temperament, and how consistently you practice. BAMK9 does not guarantee any specific training outcome. We do commit to doing our best to help your dog finish with better behavior and stronger skills than when they started.
Assumption of risk and release
Dog training involves inherent risks, including bites, scratches, dog fights, falls, and injuries from leashes or equipment. You voluntarily accept these risks for yourself, your dog, and any minors who attend with you.
To the fullest extent permitted by law, you release BAMK9, its owners, trainers, and volunteers from claims for injury, loss, or damage arising from our services, including claims based on BAMK9's ordinary negligence. Some classes and events also require a separate waiver, which applies in addition to these Terms.
Your responsibility for your dog
You are responsible for your dog's behavior and for any injury or damage your dog causes to any person, animal, or property. You agree to defend and indemnify BAMK9 against any claims arising from your dog's actions, your actions, or your breach of these Terms.
Online platform and content
Some programs include access to our online client community and training library on Skool, including homework, videos, and live Q&As. All BAMK9 training materials, videos, curriculum, and content are owned by BAMK9 and are for your personal use only. You may not copy, share, resell, or distribute them.
Where a program includes "lifetime" access, this means access for as long as BAMK9 operates the online platform. We may change platforms, update content, or change features over time. We may remove access for anyone who shares our content or behaves disrespectfully toward others in the community.
Photos and video
BAMK9 may photograph and film training sessions, classes, and events, and use images of you and your dog on our website, social media, and marketing without compensation. If you'd rather not appear in our content, let your trainer know.
Text messaging terms
If you opt in to text messages, you agree to receive messages from Body and Mind K9 LLC about appointments, class and event updates, scheduling, training support, and, if you agreed, promotional offers. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. You can also contact us at [email protected]. Carriers are not liable for delayed or undelivered messages. Consent to receive texts is not a condition of purchase. See our Privacy Policy for how we handle your information.
Using our website
The content on our website, including text, photos, videos, and logos, belongs to BAMK9 and may not be copied or used without permission. Training information on our website is general and is not a substitute for working with a trainer who knows your dog. We do our best to keep our website accurate, but we may update information, pricing, and schedules at any time.
Limitation of liability
To the fullest extent permitted by law, BAMK9 will not be liable for any indirect, incidental, or consequential damages arising from our services or website. BAMK9's total liability for any claim will not exceed the amount you paid BAMK9 for the service giving rise to the claim.
Governing law
These Terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in Los Angeles County, California. If any part of these Terms is found unenforceable, the rest remains in effect.
Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and the date at the top will be updated. Your continued use of our services after changes are posted means you accept the updated Terms.
